Federal Court Orders Release of Abrego Garcia from Immigration Custody

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. After his repatriation to the United States to answer human smuggling charges, he was held in immigration custody.

In her decision, the judge noted that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Case

The legal challenge involve disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing trial in the state of Tennessee.

Conditions of Release

The judge, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now adhere to the terms of his bond from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
